DMCA Policy

1. Overview

SpaceCloud respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to valid notices of alleged copyright infringement.

This policy describes how copyright owners (or their authorized agents) can submit a takedown notice, and how affected users can respond with a counter-notice if they believe their content was removed in error.

2. Designated agent

3. Filing a takedown notice

If you believe that content hosted on SpaceCloud infringes your copyright, you may submit a written notice to our designated agent containing all of the elements listed in Section 4. Notices missing required elements may not be actionable under the DMCA and may delay processing.

4. Required elements

A valid takedown notice must include:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material claimed to be infringing, including the specific SpaceCloud link (URL) sufficient to allow us to locate it.
4. Your contact information, including your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

5. Our process upon receiving a notice

Upon receipt of a valid takedown notice, SpaceCloud will:

• Remove or disable access to the identified material as expeditiously as possible.
• Make reasonable efforts to notify the user who uploaded the material, where contact information is available, and provide a copy of the notice.
• Inform the affected user of their right to submit a counter-notice as described in Section 6.

6. Filing a counter-notice

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our designated agent. Upon receipt of a valid counter-notice, SpaceCloud may restore the material within ten to fourteen (10–14) business days, unless the original complaining party informs us that they have filed a court action seeking to restrain the user from engaging in infringing activity.

7. Counter-notice required elements

A valid counter-notice must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and its location before removal.
3. A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal court in your judicial district (or an applicable jurisdiction), and that you will accept service of process from the party who filed the original notice.

8. Repeat infringer policy

SpaceCloud reserves the right to suspend or terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyrighted material.

9. Misrepresentation warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorney's fees, incurred by SpaceCloud or the affected user as a result of relying on the misrepresentation.
